“Terms and Conditions” are displayed below. Please note that by placing a bid on this auction, you agree to be bound by those terms and conditions.

  • All jewelry, coins, currency, stones, and precious metals will be stored offsite until preview and pickup.

  • Special arrangements are available for the removal of larger or complex-to-remove items.

  • Please preview all collections and items for exact contents, condition, and completeness.

  • Should something be listed as a “lot”, comprised of many items, please be aware that the winning bidder is responsible for the removal of all components of that lot. Items left will incur a cost for removal to be billed accordingly. 

  • Measurements are rounded to the nearest whole inch, in general offered in Imperial inches, WIDTH by DEPTH by HEIGHT, where appropriate.

  • Whenever possible, we will attempt to plug in/turn on appliances and electronics; however, please preview for working condition.

  • All items, lots, or components of such are sold AS IS/WHERE IS, with you, the buyer solely responsible for its removal.

  • We do everything we can to illuminate any defects, however we may not always notice them ourselves. If you find a disparity or discrepancy in our photographs or our descriptions, please let us know and we shall make every effort to correct the error.  We make every effort to be as accurate as possible in our identification and our description of the items, oftentimes using information from trusted professionals, family members, or other sources.  You, the potential buyer, are responsible for inspecting items prior to placing your irreversible bids.  We cannot be liable for any errors or omissions, on our part, in either labeling, cataloging, photographing, or describing these items.  If you have a question, please ask. 

  • Please take note of the preview and collection times, as well as payment details.

  • The published day is the only day available for you to collect your items. ITEMS NOT COLLECTED ON THE SCHEDULED DAY WILL BE DEEMED ABANDONED AND DISPOSED OF AT THAT TIME.

  • Credit Card Pre-Authorization: When you register for this auction, you consent to a $1 authorization on the credit card you have on file. This is a hold only; it is not a charge. Please make sure that your credit card information is current, and that the address on your bidder profile is the same address used for your credit card statement.

  • Payment: PLEASE NOTE – No payments will be accepted onsite at checkout. Your credit card will be billed immediately after the auction, and a receipt emailed to you. Should your credit card not support the charge, please make arrangements prior to pickup to pay the total amount due. Winning bidders will be required to produce a paid receipt at checkout in order to collect items from the auction. Please ensure you have proof of payment when you come to collect your items.

  • IMPORTANT: Winning bidders are responsible for packing smaller items, and dismantling, moving and loading furniture. Please ensure that you have your own labor, packing materials and equipment needed to collect your items.

  • Inspection availability and times are noted on the Auction Page and occur prior to an auction.  Some previews have established preview times and some may be by appointment only.

  • Note that all items are sold “AS IS”, “WHERE IS,” “WITH ALL FAULTS”, in its condition at the time of sale without any warranties or guarantees, either expressed or implied INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, POSSESSION, QUIET ENJOYMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

  • Bidder is responsible to inspect all items and age, condition, description, and authenticity of all items prior to placing any bid.  No purchase shall be set aside, and Gates Estates, LLC, or any of its agents, shall have no liability for, as a result of any errors in description, cataloging, mislabeling, or imperfections of any item.  All lot catalogs are merely a guide and the accuracy thereof cannot be guaranteed or warranted by Gates Estates, LLC, or any of its agents, and any lot or item information provided by Gates Estates, LLC or its representatives is not guaranteed.

  • By placing a bid, buyers acknowledge that they have either inspected the item or property in question, or obtained a satisfactory condition report.  Gates Estates, LLC recommends each item be examined thoroughly, including inspection by an independent appraiser or third-party consultant, to determine condition and whether or not items have been repaired, restored, or damaged.  Most items described in the catalog have come from estates and have, therefore, been subjected to extensive use.  Neither Gates Estates, LLC, any of its agents, or the seller make any warranty or representation with respect to the correctness of the catalog.  If previewing items in person note that the preview and lot site may be hazardous.  NO CHILDREN UNDER 18 are allowed at the preview site.

Auction Purchase and Pickup Liability Waiver and Hold Harmless Agreement
The bidder is or will be voluntary entering onto the premises represented by Gates Estates, LLC for the purpose of completing the transaction for item(s) the bidder has purchased through an auction, including picking up, removing, loading, and/or otherwise transporting such item(s) from the  Gates Estates, LLC-represented property (“Property Pickup”). In consideration of being allowed to enter onto the premises of the property represented by Gates Estates, LLC’s to complete the Property Pickup, the bidder agrees to the following terms and conditions:
The bidder assumes all risk of bodily injury, property damage or other loss of any kind from any cause while the bidder is conducting the Property Pickup, including, but not limited to, accidents, injuries, death, or damage experienced while the bidder is on the property represented by Gates Estates, LLC in connection with the Property Pickup or while the bidder is approaching, entering, disembarking from, leaving, or near any premises of the property represented by Gates Estates, LLC, including, without limitation, its warehouse and parking lots. The bidder knowingly assumes all responsibility and liability for his/her own actions while the bidder is participating in the Property Pickup and will in no way interfere with the ability of any Gates Estates, LLC agent, representative, contractor, or employee or affiliate of Property Pickup or perform his or her duties. The bidder agrees to indemnify, defend, and hold harmless Releasees from any losses, liability, damage or cost Releasees may incur due to the bidder’s activities or actions associated with the Property Pickup, whether caused by the negligence of Releasees or otherwise. The bidder further agrees to release Gates Estates, LLC, its subsidiaries, agents, affiliates, clients, contractors, employees, officers, shareholders, predecessors and successors, including the participating auction Gates Estates, LLC (“Releasees”) from any liability, claims, demands, actions, and causes of actions whatsoever, arising out of or related to any loss, property damage, physical injury, contagious disease, or death that may be sustained by the bidder while, in, on, or upon any premises, vehicles or apparatus owned, occupied, or used by any Releasee, while on the  Gates Estates, LLC’s premises, or while performing any act related to the Property Pickup. The bidder agrees to indemnify, defend and hold harmless Releasees from any loss, cost or expense, including, without limitation, reasonable attorneys’ fees, incurred by any Releasee by reason of the assertion of any claim released hereunder.
The bidder understands and agree that this Liability Waiver and Hold Harmless Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Virginia, and that, if any portion of this Liability Waiver and Hold Harmless Agreement is held invalid, the balance shall continue in full legal force and effect. The bidder agrees that this document is legally binding on the bidder’s spouse, children, heirs, next of kin, executors, administrators and assigned parties. By submitting a bid, the bidder agrees to the release and waiver of liability and indemnity agreement, and further agrees that no oral representations, statements or inducement apart from the foregoing written agreement have been made.
I, the bidder, acknowledge and agree that these terms are legally binding on my spouse, children, heirs, next of kin, executors, administrators and assigned parties. By placing bids on this auction, I acknowledge that I have read the foregoing Liability Waiver and Hold Harmless Agreement carefully and in its entirety, that I understand all of the terms and the implications thereof, that I am over eighteen (l8) years of age and of sound mind and of sound physical health, and that I accept this waiver and agreement of my own free will and in consideration of the benefits to me as set forth herein.
